These Terms of Service ("Terms") govern your use of AdCider Attribution ("Service"), operated by Nixes ("we", "us", or "our"). By using our Service, you agree to these Terms.

1. Description of Service

AdCider Attribution is a mobile attribution platform that helps developers track and analyze the effectiveness of their Apple Search Ads campaigns. The Service provides install attribution, revenue tracking, and campaign performance analytics through our web dashboard and iOS SDK.

2. Account Registration

To use our Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Be at least 18 years old or have legal authority to enter into these Terms on behalf of your organization
• Accept responsibility for all activities under your account

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code
• Use the Service to collect data in violation of privacy laws
• Resell or redistribute the Service without authorization
• Submit false or misleading attribution data

4. SDK Integration Requirements

By integrating our SDK into your mobile application, you agree to:

• Privacy Disclosure: Clearly disclose the SDK's data collection (including IDFV, attribution tokens, and transaction data) in your app's privacy policy
• User Consent: Obtain any consents required by applicable laws, including GDPR where applicable
• Data Use: Use collected data only for attribution and analytics purposes as intended
• Updates: Keep the SDK updated to maintain compatibility and security
• End-User Rights: Handle data subject requests from your app's end-users in accordance with applicable privacy laws

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. Both documents should be read together.

6. Subscription and Billing

For paid plans:

• Subscriptions are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods or unused time
• We may change pricing with 30 days advance notice
• Failure to pay may result in suspension or termination of your account

7. Intellectual Property

The Service, including all content, features, SDK, and functionality, is owned by Nixes and protected by intellectual property laws.

• Our Property: The Service, SDK, documentation, and all related intellectual property remain our exclusive property
• Your Property: You retain all rights to your data, applications, and any content you submit through the Service
• License: We grant you a limited, non-exclusive, non-transferable license to use the Service and SDK for their intended purposes

8. Service Availability

We strive to provide reliable service but do not guarantee any specific uptime or availability. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OF ATTRIBUTION DATA OR ANALYTICS PROVIDED BY THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIXES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Nixes from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of third parties, including privacy rights of your app's end-users.

12. Termination

Either party may terminate this agreement:

• By You: Cancel your account at any time through account settings or by contacting us
• By Us: We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with reasonable notice

Upon termination, your right to use the Service immediately ceases. Data retention follows our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Bulgaria and applicable European Union regulations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bulgaria, without prejudice to any mandatory consumer protection laws that may apply in your jurisdiction.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nixes
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign your rights under these Terms without our consent
